NPES Urges Action: House to Vote on 12-year Statute of Repose
WASHINGTON, DC—September 26, 2006—A vote by the United Stares House of Representatives on H.R. 3509 The Workplace Goods Job Growth and Competitiveness Act of 2005 is imminent. H. R. 3509 is a vitally needed equitable solution that will substantially reduce the burden of unfair and costly lawsuits against NPES members and other manufacturers and sellers of workplace durable goods. The legislation accomplishes this by establishing a national uniform 12‑year statute of repose that states that no civil action may be filed against the manufacturer or seller of a durable good for damages to property and/or personal injury allegedly caused by that durable good if the damage to property and/or personal injury occurred more that 12 years after the date on which the durable good was delivered to its first purchaser or lessee, and the claimant is eligible to receive Workers’ Compensation. The latter point insures that no injured worker will be without a remedy.
We now urge you to contact your representative and ask that they strengthen the U. S. manufacturing sector by Supporting H.R. 3509 the Workplace Goods Job Growth and Competitiveness Act of 2005 without amendments
