Delaware Circuit Court 5 Judge Thomas Cannon Jr. has accepted appointment as special judge in Ball State University’s eminent domain lawsuit to acquire the Hiatt Printing building at 506 N. McKinley Ave. (Muncie, IN) for construction of McKinley Commons, a $25-million hotel, dormitory and conference center.
Attorneys representing the Hiatt family asked for a change of judge because Delaware Circuit Court 1 Judge Marianne Vorhees is a BSU alum.
Ball State offered $400,000 for the building, plus financial assistance for the printing business...Chris Hiatt offered to sell the real estate for $500,000 and also wanted $449,000 in business relocation damages.
